Die EU hat ein Gesetz zur Einführung eines Grenzausgleichsmechanismus erlassen. Dieses Gesetz wirft einige Fragen hinsichtlich der praktischen und rechtlichen Durchführbarkeit auf, einschließlich möglicher rechtlicher Herausforderungen im Hinblick auf das internationale Handelsrecht. Ein wichtiger Aspekt des ⁠CBAM⁠ sind effektive Vorgaben für die Überwachung und Berichterstattung (MRV) von Emissionen aus Importen. Diese müssen scheinbar widersprüchlichen Zielen gerecht werden: Einerseits sollte ein MRV-Mechanismus für ein CBAM genauso zuverlässig und genau sein wie im europäischen ETS. Andererseits gibt es starke Argumente für die Anwendung trans- oder internationaler Standards. Die vorliegende Studie analysiert diesen Sachverhalt im Detail und entwickelt so eine grundsätzliche Perspektive für eine Lösung, die beide Ziele im Auge behält.

This paper explores possible alternatives for multilateral processes to address agriculture and climate change outside of the UNFCCC and its Koronivia Joint Work on Agriculture (KJWA). It assesses whether other multilateral processes, organizations or initiatives are fit for purpose to fulfil the expectations attached to the KJWA, support the implementation of climate action in the agricultural sector, and contribute to the effective implementation of the Paris Agreement. Whether alternative options are politically viable and can deliver on the objective of supporting climate action in the agricultural sector depends on several factors, including the political relevance of the alternative process or initiative, its inclusiveness, and financial resources. A key determinant is also how it relates to key features of the KJWA such as its substance, its participatory nature, and arrangements to capture work. Nach sechsjährigen Verhandlungen wurde bei der COP26 in Glasgow das letzte Kapitel des Regelwerks des Pariser Übereinkommens verabschiedet: die Regeln für internationale Kohlenstoffmärkte nach Artikel 6. Die neuen Regeln enthalten wichtige Anforderungen für die Beteiligung an internationalen Kohlenstoffmärkten. Sie lassen aber Schlupflöcher, die die Klimaschutzbemühungen erheblich untergraben könnten. Die Regeln allein werden nicht ausreichen, um Umweltintegrität zu gewährleisten. Wie Länder und Unternehmen Artikel 6 nutzen werden, wird für die Klimawirkung von Kohlenstoffmärkten entscheidend sein, sagt Lambert Schneider, der an den Verhandlungen beteiligt war.

The EU Emission Trading System (EU ETS) was launched in 2005. Since its inception, the scope of the system has expanded by including new countries, sectors and gases. An analysis of ETS emissions over time and across trading periods needs to account for those additional emissions. This paper presents a methodology used by the EEA to complement the emissions data available from the European Union Transaction Log (EUTL) for the period 2005–2020 with additional emission estimates in order to reflect the current scope of the EU ETS. With such estimates, it is possible to build a consistent time series of emissions under the EU ETS for stationary installations. These estimates are based on data from the ETS and the EU GHG inventory, EU legal documents, as well as data directly provided by Member States. In the end, the full data set provides a basis for assessing emission trends in the EU ETS as a whole and at the national level. This paper is an update of the one from 2019 carrying the same name with new information from publicly available sources. The report was prepared on behalf of the European Environment Agency, as partner of the ETC on Climate Change Mitigation (ETC/CM).
